Donsbach Law Group, LLC assists business clients in all aspects of employment law. Employee Leaves

We regularly advise employers on employee leave issues, which can arise under federal law like the Family and Medical Leave Act (FMLA) or other laws governing injuries, illness, or disabilities. Each of these laws includes notice, posting, and recordkeeping issues, enforced by an increasingly active federal government. We instruct employers in responding to requests for such leave, protecting the employers rights in granting or denying such leave, and defending against claims of denial of leave or illegal discrimination. We also assist employers in handling leave issues arising from military service by employees, including rights under the Veterans Benefits Improvement Act (VBIA), and the Uniformed Services Employment and Reemployment Rights Act (USERRA).

Employment Discrimination and Harassment

The most common worry of employers is the wide scope of the various discrimination laws, including Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, and other federal and state laws. We advise employers in regard to all of these laws in order to avoid litigation and also defend employers who are faced with claims arising under these laws, whether by the EEOC or OFCCP or by a private litigant in federal court. Labor Relations

Donsbach Law Group assists employers facing labor union issues, including union campaigns, strikes, and negotiating. An employer faced with a union must also defend itself in arbitrations and mediations and needs a law firm to stand for it in those situations. We have the expertise and ability to help defend your company against claims arising under union contracts or the National Labor Relations Act (NLRA).

Litigation of Employment Disputes

Our attorneys stand ready to represent employers before all federal and state courts, commissions, or administrative agencies. We have experience in jury trials, class action lawsuits, agency charges, and individual claims of harassment or discrimination.

Avoiding Litigation

A major goal of Donsbach Law Group’s practice is the avoidance of lawsuits. Most lawsuits can be avoided by following specific procedures or having in place specific policies approved by the courts and the various agencies enforcing these laws. An employer needs a strong set of policies designed to avoid the dangers presented by the various laws governing employment. As an employer grows, the need for such policies increases.

Avoiding lawsuits is a major part of our practice. We can review or propose handbook provisions, drug testing programs, harassment policies, and trade secret and confidential information protection that will protect the employer from many of the most common dangers facing businesses today. We also provide training for your supervisors and managers so they can avoid the mistakes that can lead to litigation.

Trade Secrets and Unfair Competition

Employers face more and more risk as their businesses become more technologically sophisticated. Salesmen and customer managers often leave in order to steal your customers or information. Donsbach Law Group will prepare non-compete agreements and confidentiality agreements that are enforceable under the laws governing your company. Each state has its own rules in this regard, so we will not sell you a form document, but a document created for your needs and your situation. We can and will assist in creating systems to protect your information from those who would take it away and use it against you. Wage and Hour Law

Perhaps no laws have a wider impact that the wage and hour laws facing all employers. We have years of experience in wage and hour litigation and in advising employers on how to comply with the Fair Labor Standards Act, the Davis Bacon Act, the Service Contract Act, and state laws controlling wages. We can conduct audits to identify dangers presented by your systems and help to ensure that employees are being paid in accordance with the law. We can provide plans for commissions and bonuses and vacations that will meet both the requirements of the law and the requirements of your business.

We have represented clients in responding to actions by the U.S. Department of Labor's Wage and Hour Division and by state agencies and have represented multiple employers in federal and state court actions, including class actions, regarding wage and hour law.
